Definitions

The following definitions are applicable to these terms and conditions and are binding:

  • “Productify.ai,” “our platform,” ,”the platform”, “we,” or “us” refers to the company providing the Productify.ai website (available at https://www.productify.ai ) and services. The company is Happen Software Limited, 71 Lower Baggot Street, Dublin, D02P593
  • “You,” “your,” or “user” refers to any individual or workspace whether accessing or using the Productify.ai website or services.
  • “Generated” means content that Productify.ai has presented as new and was not originally input into the system or was the result of input.
  • “Content” refers to any information, data, text, images, videos, or other materials generated or provided by Productify.ai or users of the platform.
  • “API” refers to the application programming interface provided by Productify.ai for accessing and using our platform’s services.
  • “Service tier” refers to the specific level of services purchased by the user from Productify.ai.
  • “Force Majeure event” refers to any event or circumstance beyond the reasonable control of Productify.ai, including but not limited to natural disasters, wars, terrorist acts, or government regulations, that prevents or delays the performance of our obligations under these terms and conditions.
  • “Downtime” refers to any period during which Productify.ai services are not available to users due to maintenance, upgrades, or other modifications to the platform.
  • “Intellectual property” refers to patents, trademarks, service marks, copyrights, trade secrets, and other proprietary rights and laws.
  • “Malware” refers to any malicious software or program designed to disrupt or damage computer systems or networks.
  • “Personal information” refers to any information that identifies or can be used to identify an individual, including but not limited to name, address, email address, and phone number, as defined by GDPR (Europe/Ireland) privacy laws.
  • “Acceptable use policy” refers to the rules and restrictions on the use of the Productify.ai platform and content, as outlined in these terms and conditions and other Productify.ai policies and rules.
  • Publication: means distributing content created by using the services of the platform for any purpose, commercial or otherwise.
  • Human review: means an individual user diligently scrutinising the content produced by the platform with due regard to accuracy and the other provisions of Acceptable Use as outlined in the Terms and Conditions and policy documents.

  1. By using Productify.ai, you agree to these terms and conditions. If you do not agree to these terms, you should not use Productify.ai.
  2. These terms and conditions apply to both you as an individual and any organization on whose behalf you are accessing or utilising Productify.ai.
  3. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to notify us immediately of any unauthorized use of your account.
  4. You may not use Productify.ai for any illegal or unauthorized purpose. You agree to comply with all applicable laws and regulations in your country of operation.
  5. We respect intellectual property rights and expect our users to do the same. You agree not to upload or share any content that infringes on the intellectual property rights of others. If we receive a notice alleging that you have violated someone else’s intellectual property rights, we may remove the content in question and terminate your access to Productify.ai. If you believe your copyright or intellectual property rights have been infringed, please let us know support@productify.ai.

  7. We use artificial intelligence to generate content on Productify.ai. While we strive to ensure that the content generated is reasonably accurate and factual, by using this platform you accept that this technology is not perfect and that the responsibility remains with you to validate any claims made before you use this content by way of human review.
  8. We will use commercially reasonable efforts to ensure that Productify.ai is always available and operational. However, we do not guarantee a specific level of uptime or availability, and we are not liable for any damages or losses arising from downtime or interruptions in service.
  9. In the event of any downtime or interruption in service, we will use commercially reasonable efforts to restore services.
  10. You acknowledge that Productify.ai may be subject to occasional maintenance, upgrades, or other modifications, which may result in temporary downtime or interruptions in service. We will use commercially reasonable efforts to minimize any impact on your use of Productify.ai during such periods.
  11. You agree to notify us immediately if you experience any issues or problems with Productify.ai, including downtime, performance issues, or other errors. You must notify us as at support@productify.ai. We will investigate and respond to your concerns as quickly as is reasonably possible during normal working hours which are Monday to Friday 9am to 5pm GMT+0.
  12. When you access or use ai, you agree that Ireland (European Union) laws will be the only laws that apply to the rules of Productify.ai and to any disagreements or problems related to it. If you have a legal issue or dispute with Productify.ai, it must be dealt with exclusively in Ireland courts and regulators. By using Productify.ai’s services, you accept that only these courts and regulators can handle any issues and disputes, and you won’t argue about the jurisdiction or that the court location is inconvenient or unsuitable for your case.
  13. By using Productify.ai, you agree to follow our complaint process for site-related issues. Email a detailed complaint support@productify.ai , including relevant info. We will review and respond within a reasonable time. Not following these steps may cause delays in resolving your concerns.
  14. Productify.ai is not intended for use by children. By using Productify.ai, you confirm that you are at least 18 years old. We assume no responsibility or liability for any use of the website by children under the age of 18, and their access to or use of the site is strictly prohibited. Parents or guardians are responsible for monitoring and supervising their children’s access to and use of Productify.ai.
  15. Disclaimer: By using Productify.ai and any generated content, you acknowledge and agree to the following:
    • System Requirements: We are not liable if your systems are inadequate or incompatible with our services.
    • Third-Party Providers: We are not responsible for any third-party failures or non-compliance affecting your experience on our site or impacting the availability of services offered on our platform.
    • Relationship: Our relationship is that of independent parties, not a partnership, employment, or any other relationship.
    • Child Protection: We are not liable if an underage individual gains access to the site, and it is the guardian’s responsibility to supervise their usage.
    • Fit for Purpose: We do not guarantee that our AI-generated content will always meet your expectations or be suitable for your intended purpose. By using Productify.ai, you specifically acknowledge this and accept that you do not have the right to claim compensation for damages suffered due to the use of the website.
    • Uploaded Content & Malware: We are not responsible for any issues arising from uploaded content or malware introduced by users.
    • Consent to Tracking: By using our site, you consent to tracking and traceability measures in accordance with our Privacy Policy.
  16. API Use: Any use of our platform’s API is subject to our API terms of service and any related documentation.
  17. API Terms of Service: By accessing and using our platform’s API, you acknowledge and agree to the following terms:
    • Use of Content: You are responsible for any content generated using our API, whether reviewed or approved by you or your representatives. This includes content that is directly or indirectly distributed or published.
    • User Liability: You accept full liability for the distribution or publication of any content produced by our platform, regardless of whether it has undergone human review or approval by you or your representatives.
    • You agree to indemnify and hold us harmless from any claims, damages, or losses that may arise because of your use, distribution, or publication of the content generated by our API.
    • Compliance with Laws: You agree to comply with all applicable laws and regulations related to your use of the API, including, but not limited to, copyright, privacy, and data protection laws. You are solely responsible for ensuring that the content generated through our API and its distribution or publication adheres to these laws and regulations.
    • Termination of Access: We reserve the right to terminate or suspend your access to our API at any time, with or without notice, for any reason, including but not limited to violation of these terms or any applicable laws or regulations.
    • By accessing and using our platform’s API, you accept these terms and agree to abide by them. Failure to comply with these terms may result in termination of access and potential legal consequences.
  18. Use of Productify.ai and the website content is entirely at your own risk.
    • You hereby indemnify and release Productify.ai from any debt, liability, expense, claim, penalty or damage (whether direct, indirect, special or consequential) that you or Productify.ai may incur from your use of the website, your reliance on this web page or the web page content, or any actions or transactions resulting therefrom, even if Productify.ai has been advised of the possibility of such loss, liability, expense, claim, penalty or damage.
  19. Limit on Liability:
    • When using Productify.ai or it’s services, you agree that if any problems arise for which our liability is established or accepted by us that we will not be responsible for paying more than the total cost of your transaction or $1,000, whichever is less.
    • This limit applies to any type of claim, no matter what legal basis it has, and even if we were warned that the problem might happen. By using our site and services, you understand and accept that the most we will pay for any issue is the amount stated here.


Acceptable Use Policy

  1. By using Productify.ai and the content generated on this platform, you agree not to engage in prohibited content and conduct, which includes but is not limited to:
  •  Illegal Activities: Do not use Productify.ai, or the content generated on this platform, for any activities that violate European/Irish laws, the laws of your jurisdiction or any applicable regulations.
  • Harassment and Discrimination: Do not use the content generated on this platform to harass, threaten, or discriminate against others based on race, ethnicity, religion, gender, sexual orientation, or any other protected characteristic.
  • Harmful Content: Do not share, create, or promote content that is violent, sexually explicit, hateful, or that encourages dangerous activities using the content generated on this platform.
  • Privacy Violations: Do not use the content generated on this platform to share personal information about others without their consent or engage in any activity that may compromise the privacy of others.
  • Spam and Unsolicited Communications: Do not use the content generated on this platform to send unsolicited messages, promotions, or advertisements to other users, or engage in any form of spamming activity.
  • Misuse of Productify.ai: Do not attempt to hack, damage, or gain unauthorized access to Productify.ai, its systems, or any user’s account.
  1. Non-compliance with Terms and Conditions:
    • Use of Productify.ai and its services, as well as the content generated on this platform, only as intended and in accordance with our Terms and Conditions.
    • Do not engage in any activity that violates these terms. Failure to adhere to this Acceptable Use Policy may result in the removal of content, suspension of your account, or other appropriate actions at our sole discretion.
  2. Force Majeure: Sometimes, events outside of our control may prevent us from fulfilling our obligations under these Terms and Conditions. These events are called Force Majeure events and may include things like natural disasters, wars, terrorist acts, or government regulations.
    • If a Force Majeure event occurs, we will try to minimize the impact on our obligations under these Terms and Conditions. If the Force Majeure event lasts for more than five weeks, either party may terminate these Terms and Conditions.
    • We will not be held liable for any delay or failure to perform our obligations under these Terms and Conditions due to a Force Majeure event.
    • These terms and conditions constitute the entire agreement between you and us, and they supersede any prior agreements or understandings, whether written or oral.
  3. If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions of these Terms and Conditions shall remain in full force and effect, and the affected provision shall be modified to the extent necessary to render it enforceable while preserving the parties’ original intent.
